Terms of Service

1. Agreement

By using TaleHive, an app made by Smartbee LLC ("we", "our", or "us"), you agree to these Terms of Service ("Terms") and to our Privacy Policy. If you don't agree, please don't use the app.

If you downloaded TaleHive from the App Store, Apple's Standard Licensed Application End User License Agreement also applies. These Terms add to it and do not replace it.

2. What TaleHive Does

TaleHive creates personalized children's storybooks — text, illustrations and narration — using artificial intelligence, based on the details and photos you provide. Creating a story uses credits, which you buy through Apple In-App Purchase.

3. Your Account

You must be at least 18 years old (or the age of majority where you live) and the parent or legal guardian of any child whose information you enter. You're responsible for activity under your account and for the information you add about your child and family.

4. Credits and Purchases

  • Credits are sold through Apple, and prices are shown in the app before you buy. Credits are one-time purchases; there are no subscriptions.
  • Credits are used when a story is created. They have no cash value and can't be transferred.
  • If a story fails because of a problem on our side, or you cancel or delete it while it's still being created, the credits are returned to your balance (or your free first book is restored — for repeated cancellations, this is limited). Credits aren't returned once a story has been completed.
  • New accounts may receive one free storybook. This offer is limited to one per Apple ID, including after an account is deleted and created again.
  • Refunds of purchases are handled by Apple under Apple's policies.
  • We may change credit prices or what a credit buys; changes apply to future purchases.

5. AI-Generated Content

Stories, pictures and narration are made by AI and may contain mistakes, oddities or content you didn't expect. Please review a story before reading it to a child. We don't guarantee that generated content is accurate or suitable, and you use it at your own discretion.

6. What You May Not Do

  • Try to produce sexual, violent, hateful or otherwise harmful content, especially involving children
  • Upload photos of anyone other than your own children unless they — or, for a minor, their parent or guardian — have agreed to it
  • Try to extract, reverse-engineer or misuse TaleHive or the AI services behind it
  • Resell stories or use TaleHive to build a competing service

We may suspend accounts that break these rules.

7. Your Content

You keep the rights to the details and photos you provide, and you let us use them to run TaleHive for you. Stories created for you are yours to read, print and share for personal, non-commercial use. We keep copies to operate the service.

Shared links can be opened by anyone who has them until they expire, 90 days after you last share them. People who open a shared link can save a copy of that story to their own library.

8. Our Content

The TaleHive app, its name, design and software belong to Smartbee LLC.

9. Ending Your Use

You can stop using TaleHive at any time and delete your account in the app under Settings › Account › Delete Account, or by emailing us. Unused credits are lost when you delete your account.

Deleting your account deletes your stories, photos and other content from our servers, as described in our Privacy Policy. Copies of stories you shared that others saved to their own library stay with them.

We may change or end the service. If we shut it down, we'll give reasonable notice.

10. Disclaimer of Warranties

TaleHive is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that TaleHive will be uninterrupted, error-free or always available.

11. Limitation of Liability

To the maximum extent permitted by law, Smartbee LLC is not liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data or other intangible losses, resulting from:

  • Your use of, or inability to use, TaleHive
  • Any errors or inaccuracies in generated content
  • Unauthorized access to your data
  • Any third-party conduct on TaleHive

Our total liability for any claim is limited to the amount you paid for TaleHive in the twelve months before the claim.

12. Indemnification

You agree to indemnify and hold harmless Smartbee LLC from any claims, damages or expenses arising from your use of TaleHive, the information and photos you add, or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Travis County, Texas.

14. Changes to These Terms

We may update these Terms. We'll post the new version here and change the date at the top. Continuing to use TaleHive after changes take effect means you accept them.
